Dear Colleague,

The Association is aware of your concern regarding the on-going trend of violation of laid down rules of cadre management by posting non-IFS officers against the IFS Cadre posts. Kindly note that this issue was taken up for the discussion in several meetings of the Association, and again on 23 November 2011 when it was noted with tremendous concern and despondence that the representations made in this regard to the PCCF HOFF, ACS FEE and the Chief Secretary have not remedied the situation.

As per the spirit enshrined in the Constitution of India regarding All India Services, and the cadre rules framed in this regard, it cannot be denied that the sensitive posts like territorial divisions and wildlife divisions that are IFS cadre posts and have territorial-jurisdiction and regulatory/law implementation functions, must be manned by the IFS officers. However in case of compelling situation (and as an extraordinary measure only) such posts could be filled up by non-IFS officers those are on the Select List for promotion to IFS cadre.

The Association notes that with each passing day, the number of cases of such violation (anomalous postings) is increasing which is resulting in erosion of confidence among the IFS Officers in general and particularly among those working at DCF level. This has direct implication for overall forest protection and management in the state.

In view of the above, in the meeting held on 23 November 2011 it has been decided to avail of the last available remedy of approaching the honorable CAT for addressing the anomaly.

To successfully address the anomaly mentioned above support of all the members is necessary. In the first instance therefore, you are requested to share your considered opinion on the above issue within a week after which action will be taken to file the application in honorable CAT.

    I fully endorsethe view taken by the Association to approach CAT, seeking legal remedy, against the posting of non-cadre officers in Cadre posts. Let us all contribute for the expenditure involved in legal recourses, in the best interest of our service.

Dear Members, I take this opportunity to share with you that in the Extraordinary GBM of the Association held on 3 February the resolution of the Executive Committee regarding seeking legal remedy has been considered and endorsed. Consequently, in this regard, in the week starting 27 February, we are likely to be through with filing impleading application in honorable CAT at Bangalore. Jagmohan Sharma

  3. Gosh……… Finally the association has realised where we are heading..!!!!..thankgod..Time is ripe for legal recourse indeed. Too much damage is already done and if continued in slummbers, it would result in irrepairable damage and an unhealthy trend setter.

    • Dear Sir, the case has been admitted in honorable CAT and will be called for hearing on 29 march. I hope to be present in the court hall when the case is taken up.
